mySAE is a service that allows current SAE students, graduates, and members of the SAE Alumni Association to participate in an international online community, which is used for the presentation of information on SAE but also constitutes a platform for members to post information on themselves, their companies, and products or services. For this purpose, content, such as audio files, text, and images, can be posted on mySAE.
This information is accessible to the public and is used to supply individuals or businesses with interesting offers or contact information. The term “public“ applies to members of the mySAE user community and other visitors to the site. The retrieval of such information or contacts, however, is controlled by a rights management system regulating the extent of access for different user groups.
mySAE also provides forums/discussion groups for the exchange of information between users.
This agreement may be modified from time to time, and the user agrees now to be bound by any future changes unless they infringe considerably upon his/her rights.
2. Privacy Policy:
By logging on to mySAE for the first time, the user gives his/her express permission for the retrieval of personal information, i.e.
name
gender
level of education at SAE
employment status at SAE
ALUMNI Association membership
ALUMNI Chapter affiliation
date of entry for ALUMNI Association membership
from the databases of SAE or SAE ALUMNI Association and understands that this basic personal information is not user-editable and can be publicly viewed. Changes to said data can be requested by contacting the site operator. All supplementary information, such as contact information, SAE history, favourites, personal interests, etc., can be entered and edited by the user. All information in the category "Personal + Lifestyle" is viewable only by members of the mySAE community.
Entering this supplementary information is optional and is used only for the presentation of the respective user and are saved for this purpose only. The user understands that any information provided may be used to improve layout and user friendliness of mySAE and to update the databases of SAE or SAE ALUMNI Association and that information entered on or transmitted to mySAE (such as logins, email addresses, password, information on speed and type of internet connection, browser type and version number, operating system, visitor history, etc.) may be stored for said purpose. The user agrees to the the use of cookies, flash cookies, or similar software applications for the retrieval and verification of such information.
Any information so acquired will be used exclusively for the purpose outlined above, and the operator of the website will not pass on any of said information to a third party.
It cannot be ruled out that shares in the company, the company itself, or parts of it are sold. In such legal transactions, user information is usually transferred along with other assets. In this case, the privacy policy and data security measures in effect apply to the new owner as well.
The party legally responsible in terms of data privacy laws is the operator listed in the section “Imprint”.
3. Advertisement and Links:
mySAE includes advertisement and links to web pages of third parties. mySAE is not responsible for any such third-party services and websites and cannot reasonably ensure that those meet the appropriate legal requirements.
4. Proprietary Rights:
The user declares that he/she holds all proprietary rights to material that is uploaded and thus made publicly accessible onmySAE. This includes but is not limited to copyrights, intellectual property rights, trademarks, etc. The use of text, pictures, photos, videos, audiofiles, etc., is allowed only if the user holds all rights thereto or has been granted the right by the holder(s) to upload the material to mySAE.
Examples:
Upload of audio files: rights of the composer(s), lyricist(s), record companies, performance rights organizations (such as GEMA, AKM/Austro Mechana, SUISA, SACEM, etc.). In cases where the protection of proprietary rights has already been entrusted to a performance rights organization (e.g., songs registered with GEMA), users first have to obtain a license for the upload of the file in question, even if they themselves are the creators.
Upload of photographic material: rights of the photographer, rights of the persons depicted
Upload of videos: rights of the producer; for non-commercially-produced films also the rights of other parties involved: actors (all depicted, where recognizable), scriptwriter, other writers, score composer, director, animation programmers, etc.
Use of graphics: rights of the designer (illustrator, etc.), trademarks.
Use of textual material: rights of the author; personal rights of third parties whose rights have been infringed upon by a description of their person or by the mention of names or details used in the publication of libelous or factually incorrect statements or truthful statements that constitute a violation of privacy.
Use of cover illustrations: all rights to cover artwork usually lie with the publisher or label. Where used primarily for promotional purposes of the artwork itself, the use of such artwork usually doesn't require a separate license.
5. Use of Services:
The user is authorized to participate in services offered by mySAE on the condition that he/she:
does not post any illegal content (in the form of text, information, photos, videos, etc.) on mySAE. The term "illegal" in this sense not only refers to measures that result in criminal prosecution but also to those that violate the rights of any person. This includes, but is not limited to, racist or pornographic content, the defamation of religions or national symbols, solicitation to commit criminal acts, slander, insults, indefensible personal attacks, the use of copyrighted material without prior authorization by the copyright holder(s), etc.
is 18 years of age or older and legally capable of agreeing to the provisions set forth in this agreement.
6. Rights and Liability of Operator:
mySAE reserves the right to remove any content or to restrict, suspend, or terminate a user's access to all or any part of the services at any time, for any or no reason, with or without prior notice.
mySAE is not responsible for any incorrect or inaccurate content posted on its website and assumes no responsibility for the destruction or alteration of posted data.
7. Application of Law:
German law applies to the participation in the services offered by this website.
mySAE assumes no responsibility or liability where content of this website does not conform to laws of other countries. Participation in the services of mySAE is at the sole request of the user and entirely at his/her own risk.
